課程概述 |

1、課程討論主題：競爭法及營業秘密案例（Competition and IP: Law, Policy and Case Study）。
2、本課程雖開設在法學院，但開放其他學院及領域同學修課。
3、本課程由兩位國內及國際知名跨國企業inhouse律師，主導討論實際案件之處分或判決資料，以實務觀點去理解智慧財產制度。每次上課前之課前閱讀資料，均為英文。
4、配合主導討論實務專家時間，每週實際上課時間為15:30-18:00（縮短中間休息時間），隔週上課。具體上課週數於開學第一週確定。

課程目標 |
一、The goal of this course is to equip law students, MBA students, or upper-level undergraduate students with essential analytical framework and tools to discuss and litigate cutting-edge topics concerning competition law and intellectual property.
We will use real-life cases to present the issues involved and illustrate how US courts, through the adversary litigation process, develop laws to strike a balance between competing interests. Through the process, the students are expected to have a handle on the basic statutory and analytical framework and also develop the ability to independently research on any competition and IP topics.
二、本課程希冀修課同學瞭解目前智慧財產法院之實務運作及案件審理，修課同學須自行至智慧財產法院旁聽案件及撰寫觀摩意見、案件評論 |

課程要求 |
一、There will be no exam. The grade will be based on in-class discussion (50%) and a written assignment. (30%) The written assignment will be a summary judgement motion arguing for or against a single issue covered during the semester.
三、為使修課同學瞭解智慧財產訴訟實務運作，每位修課同學必須自行擇期至智慧財產及商業法院旁聽至少一庭案件審理，智慧財產領域之任何類型皆可。旁聽案件庭期，可由智慧財產及商業法院網站查詢。 |
